Will my name be released?
Only to necessary authorities, including prosecutors, police, and the defendant if a crime, delinquent act or child protection legal petition is filed in court.

Am I a mandated reporter 24/7?
Technically, you are only mandated to report when you are acting in your professional capacity . . . but if the information came to you because of your job, resolve any discrepancy in favor of reporting.
AND: anyone can make a report (and be legally protected!)

Do I have to tell the parent I’m reporting?
No.  And – SAFETY FIRST – don’t!  This puts the child at additional risk! Plus – the law may require you NOT to tell of an active investigation.

Do I have to report if the alleged perpetrator is a school employee?
Yes – and to additional places, including the Department of Education.

Can I just bring the information to my supervisor or the school social worker and let them or an administrator make the report?
No. It’s your personal responsibility. No one else knows exactly what the child said, where & how.

Do I have to report if I know a mandated reporter from another agency is already involved?
Yes.  Anyone the child told needs to report.  Note that if it’s about credibility and corroboration, all whom the child tells are important!

Do I need to report if I learn that a child is involved in sexual activity with another child?
Yes.  It may qualify as criminal or delinquent activity, and likely qualifies as sexual abuse, depending on the circumstances/ages.  It should be checked out.

Does the alleged perpetrator have a chance to respond to any allegations?
Of course.  If the allegations are found to be supported, the perpetrator can appeal administratively, or if a crime is charged, full constitutional rights and protections apply.

BOTTOM LINE:
If you’re not sure, report.
The “consequences” only come if you DON’T.
